Barry Goldner and Todd Egland recently obtained an extremely favorable result for an industrial business client.  The business received notice of a sizeable environmental damage claim.  KDG tendered the claim to the insurance company, which denied coverage.  Multiple efforts were made to have the insurance company provide coverage—but the insurance company  flatly denied coverage and refused to defend the claim.  An action was filed in Federal Court to seek declaratory relief.  KDG was able to handle the case efficiently and sought summary adjudication of its right to coverage.  The insurance company filed its own motion.  KDG’s client prevailed and the Court determined that KDG’s client was entitled to coverage.  The insurance company will not be appealing the result.  The dispute is in the process of being resolved.  KDG’s client is very pleased with the outcome.
