International Business

KDG is the only law firm in California's Central and Southern San Joaquin Valley with experienced attorneys specializing in international business. International business transactions such as foreign direct investment, investment by foreign companies in the U.S., exports, imports, and hiring foreign nationals involve many complexities. KDG's attorneys are experienced in helping clients to navigate these complexities.

KDG attorneys are also experienced in international intellectual property matters including the filing of international applications under the Patent Cooperation Treaty, filing applications for trademark registration under the Madrid Protocol, and the filing of arbitration claims against foreign entities under the Uniform Domain Name Dispute Resolution Policy.

KDG attorneys have extensive experience representing clients in litigation and arbitration matters requiring the use of international treaties in order to complete written discovery and the examination of witnesses.

A major component of this practice is advising clients regarding compliance with U.S. regulation of exports, imports, financial transactions, and compliance with the Foreign Corrupt Practices Act (FCPA) and the North American Free Trade Agreement (NAFTA). For instance, we assist growers who wish to export agricultural goods to sanctioned countries. Further, we advise companies who export oilfield equipment and services to foreign countries on how to protect themselves from doing business with a sanctioned individual or an individual who might engage in acts violating the FCPA.

KDG also works with clients wishing to employ foreign nationals to obtain the appropriate visas. Along the same vein, KDG advises clients hiring foreign nationals regarding compliance with deemed export controls. For example, if a company hires a foreign national from a sanctioned country, such as Cuba or Iran, the company could be engaging in a deemed export in violation of the U.S. export control regulations. Our attorneys work with our clients to identify these risks and comply with all applicable laws and regulations.
