Removal of Trustee Reversed on Appeal

Klein DeNatale Goldner's client and his brother are successor trustees of their mother's trust. They disagreed over trust administration and sought the court's intervention on specific items, but the trial court decided (on its own) to remove Klein DeNatale Goldner's client as a trustee. The court of appeal agreed with Klein DeNatale Goldner's client that the removal was in excess of the court's power. The appeal was led by Klein DeNatale Goldner attorneys Catherine E. Bennett, and Joseph D. Hughes. Tinsley v. Tinsley, reversed unpublished opinion, 2011 WL 1491079.
